South Korea’s liberal rulers unleash their inner authoritarians

Used to dishing out the criticism, they seem unwilling to take it

한국의 진보통치자들 그들 내면의 권위주의를 들어내다

비판을 쏟아내던 그들이 그들 자신에 대한 비판은 받아드리지 않으려 한다

SOUTH KOREA has a proud history of noisy opposition to the powers that be. Japanese colonisers found their subjects unruly. Homegrown military dictators, who brutally suppressed their citizens’ democratic yearnings for decades, eventually yielded to widespread protests. Even democratically elected leaders have incurred the wrath of civil society. Park Geun-hye, the predecessor of Moon Jae-in, the current president, was chased out of office in 2017 after millions of South Koreans took to the streets to decry rampant corruption in her government.

대한민국은 과거 일제 식민 통치자들도 감당 하기가 어려웠을 만큼 권력자들에게 끈질기게 저항 해온 자랑스러운 역사를 가지고 있다. 자국민들의 민주화 염원을 수십년간 매몰차게 탄압했던 군부 독재자들도 결국 만연하는 시위대에 굴복하고 말았다. 비단 민주적으로 선출된 지도자들도 민중의 분노를 일으키게 했다. 현 문재인 대통령의 전임자인 박근혜 대통령도 2017년 재임 중 정권 부정을 외쳐대는 수백만 시위군중 때문에 대통령 직에서 물러나게 되었다..

Ms Park’s left-wing successors had vowed to do better. Mr Moon, a former activist and human-rights lawyer, and his Minjoo party claim to embody the legacy of the pro-democracy movement. They promised to honour the spirit of the protests that swept them to power. The country would become more egalitarian. The government would be more open, tolerant of dissent and responsive.

전임 박근혜 대통령으로부터 정권을 득한 좌익 정권도 더 나은 정치를 하겠다고 다짐한 바 있다. 과거 운동권 출신이고 인권 변호사인 문재인 대통령과 집권당인 민주당은 민주화의 유산을 구현 하겠다고 나서고 있다. 이들은 전 정권을 무너트린 시위 정신을 존중하기로 약속하였다. 그리고 앞으로 더더욱 평등하고 개방적이며 반대 의견에도 관대하게 대응하겠다고 약속했었다. 

Those good intentions seem to be flagging. Opponents of the government are again finding that their views may attract litigation rather than benign indifference or even constructive responses. Nearly a fifth of civil libel suits against media organisations last year involved senior officials, more than during Ms Park’s administration.

이러한 선의의 의도들이 쇠퇴하고 있는 것 같다. 정부에 대한 반대 의견에 대하여 무관심이나 건설적인 대응을 하기 보다는 오히려 소송으로 돌아온다. 작년도에 언론기관을 상대로 제기된 명예훼손 민사 소송 건 20%가 정부 고급 관료들과 관련이 있으며 이는 박근혜 정부 때보다 많은 상황이다.

Last month the president’s office appealed against a court ruling that cleared a conservative newspaper of defaming Mr Moon’s wife in an opinion column (the writer mused over whether the couple’s official overseas trips were too heavy on sightseeing). A right-wing YouTuber has been jailed for spreading rumours about Cho Kuk, a former senior official in Mr Moon’s government (Mr Cho has since been disgraced).

지난달 청와대는 한 보수 언론의 오핀니언 칼럼 관련 영부인 명예훼손 소송 건에서 무죄 판결이 나오자 이에 불복하여 상소를 제기 하였다.(작가는 대통령 내외의 공식 해외 순방이 관광에 너무 치우쳤다고 언급함). 한 우파 유투버는 문재인 정부의 전 고위 관료였던 조국 씨에 대한 루머를 퍼트린 혐의로 투옥 되기도 했다.(조국 씨는 이후 명예롭지 못하게 자리에서 물러났다).

The Minjoo party lodged a criminal complaint against a political-science professor after she criticised it for being self-serving and suggested that progressives should vote for other parties; the complaint was withdrawn after a public outcry. NGOs led by North Korean refugees who dislike the government’s conciliatory stance towards the North have lost their non-profit status and allege police harassment.

한 정치학 여성 교수가 민주당은 자기들만의 이익만 챙긴다고 비판하고 진보 진영은 다른 당에 표를 던져야 한다고 제안 하자 민주당은 이 교수를 상대로 형사 고발을 제기 했다. 이 고발에 대한 여론이 악화 되자 소를 취하 하였다.정부의 북한에 대한 유화정책을 못마땅하게 여기는 탈북자들이 운영하는 비 정부 기관들 즉 NGO 들이 그들의 비영리 법인자격을 상실 했으며 경찰의 탄압을 주장하였다.

There is trouble in the legislature, too. Earlier this month Minjoo lawmakers proposed a bill that would grant the government the power to order the media to correct “fake news” (a similar bill was proposed by the conservatives in 2017). Another set of bills being considered seeks to punish anyone spreading “distorted” historical accounts of a crackdown in 1980 on pro-democracy protesters.

국회에도 역시 문제가 있다. 이달 초 민주당 국회의원들은 정부로 하여금 언론에 대하여 가짜 뉴스 정정 명령을 할 수 있는 법안을 발의 하였다.(2017년 유사한 법안이 보수의원들에 의하여 발의된 바도 있다.) 5.18 민주항쟁의 역사를 왜곡하는 행위를 처벌하는 법안들도 입법 추진 중에 있다.

Park Kyung-sin, a law professor and free-speech advocate at Korea University, thinks the government’s touchiness in the face of criticism has its roots in “a long-standing vendetta between progressives and the conservative media”. Even in government, left-wingers have not shed their self-image as underdogs. They tend to think of certain media outlets as arms of political parties, and have a “siege mentality” when it comes to their critics.

자유언론 지지자인 박경신 고려대 법학교수는정부가 비판에 민감해 하는 것은 진보와 보수언론  사이에오랫동안 있어온 앙갚음에 뿌리를 두고있다고생각하며 정부내의 좌파인사들 조차그들의 자신없는이미지를떨쳐내지 못하고 있으며그들은특정매체를 정당의 무기로 여기는 경향이 있고 비판에 직면할 때면 상대방으로부터 포위되었다는 강박관념에 젖어 있다고 말한다.

Activists forged their political identities against a military dictatorship implacably hostile to their aims, so opponents’ freedom of expression was not a priority. South Korean politics—and many media organisations—remain polarised, with cross-party co-operation virtually unheard of. Loyalty to one’s own camp is prized above all. Kim Kyung-ryul, a progressive intellectual who broke with his former comrades over attitudes to Mr Cho’s conduct earlier this year, has likened the two main parties to “backstreet gangster groups” serving only their own interests.

운동권 출신들은 군부 독재에 맞서며 강인한 전투력을 배양했기때문에 반대자들의 표현의 자유는 아예우선순위 밖에 두게 되었다. 한국의 정치계와 많은 언론기관들은 전례없는 초당적 협조로서 양극화를유지해오고있다. 이들은 자기진영에 충성하는것을무엇보다도소중히 여긴다. 금년초 조국씨의 행동에 관하여 본인의태도 문제 때문에 옛동료들과 사이가 소원해진 김경률씨는양대 두정당을자신들의 이익만  추구하는뒷골목깡패집단에 비유하기도 했다.

Mr. Park is keen to stress that current developments are less worrying than the systematic use of criminal defamation law against political opponents that occurred under previous administrations. Some Minjoo lawmakers are still trying to soften the country’s punitive defamation laws, whereby journalists and ordinary citizens can get long prison sentences for damaging reputations, even if their offending statements are true. Despite the recent litigiousness of some of their colleagues, South Korea’s rank on the world press-freedom index is higher than it was a few years ago.

박교수는 전정권하에서 정적들에게 명예훼손형사법을 조직적으로 적용했던것 보다는 현상황이 좀더 나은편이라고 강조한다.몇몇 민주당 국회의원들은 지금도언론인들이나 일반인들이 비록그들의 주장이 시실이라도 그들의 형량이 높을 수 있는 징벌적 명예훼손법을 완화하기 위해 노력하고 있다고 말한다.최근있었던그들동료들간의 소송건에도 불구하고 한국의 세계자유언론 지수는 몇 년 전 보다도 높게 나와있다.  

South Korean politicians love to quote ancient wisdom. The government might do well to ponder the words of King Sejong, a model ruler and rich source of inspiring quotations from the Joseon era. “I am neither virtuous, nor skilful at governing. There will definitely be times when I do not act upon the heavens’ wishes. So look hard for my flaws and make me answer to their reprimands,” he said, in 1425.

한국의 정치인들은 옛 성현들의 지혜를 인용하기 좋아한다.정부는 조선시대의 표본적 통치자이며 풍부한영감을 얻을 수 있는세종대왕의 어록을 유용하게 인용 했으면 한다. “짐은 도덕군자도아니고 능력있는 통치자도 아니오. 하늘의 뜻을 거스르는 일이 필시 있을 것이오. 따라서 짐은열심히 나의 결점을 헤아릴 것이며하늘의 질책에 응대할 것이오.” 라고 1425년세종대왕께서 말씀 하셨다.
